Welcome to Aperture Academy! These terms and conditions outline the rules and regulations for the use of Aperture Academy's website and services, located at www.apertureacademy.com.au. By accessing this website and/or purchasing courses, you accept these terms and conditions in full. These Terms and Conditions constitute a legally binding agreement between you (the “User”) and Aperture Academy Pty Ltd (ABN 12 345 678 901), located at 12/45 Flinders Lane, Melbourne, VIC 3000, Australia (“Aperture Academy”, “we”, “us”, or “our”). This agreement governs your access to and use of the Aperture Academy website, courses, and related services (collectively, the “Services”).

Account Terms

  1. Eligibility: You must be at least 18 years old to create an account and purchase courses on Aperture Academy. By creating an account, you represent and warrant that you are at least 18 years old.
  2. Account Creation: To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  3. Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to immediately notify Aperture Academy of any unauthorized use, or suspected unauthorized use of your account or any other breach of security. Aperture Academy will not be liable for any loss or damage arising from your failure to comply with these requirements.
  4. Account Termination: Aperture Academy reserves the right to suspend or terminate your account at any time for any reason, including, but not limited to, violation of these Terms and Conditions. Upon termination, your right to use the Services will immediately cease.

Service Usage

  1. Course Access: Upon payment of the applicable fees, Aperture Academy grants you a non-exclusive, non-transferable, revocable license to access and use the purchased courses for your personal, non-commercial use.
  2. Prohibited Conduct: You agree not to:
    • Use the Services for any unlawful purpose.
    • Upload, post, or transmit any content that is infringing, defamatory, obscene, or otherwise objectionable.
    • Interfere with or disrupt the operation of the Services or the servers or networks used to make the Services available.
    • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services.
    • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without the express written permission of Aperture Academy.
  3. Course Content: The content provided in the courses is for educational purposes only. Aperture Academy makes no warranties, express or implied, about the accuracy, completeness, or suitability of the content for any particular purpose.
  4. Payment Terms: You agree to pay all fees and charges specified in connection with your purchases of courses. All fees are non-refundable unless otherwise stated in our refund policy, which is available here. Aperture Academy reserves the right to change its fees and payment policies at any time.

Intellectual Property

The Services and their original content, features, and functionality are owned by Aperture Academy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limitation of Liability

To the fullest extent permitted by applicable law, Aperture Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (c) unauthorized access, use, or alteration of your transmissions or content.

Specifically, while Amelia Stone and other instructors provide expert advice based on years of experience in the field of photography, Aperture Academy is not liable for failures in your own photographic endeavors. Learning photography takes dedication and practice, and results will vary from person to person.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms and Conditions or the Services shall be instituted exclusively in the courts of Victoria, Australia.

Policy Updates

Aperture Academy reserves the right to modify or replace these Terms and Conditions at any time. We will provide notice of any material changes by posting the updated Terms and Conditions on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms and Conditions.
